What is an advance payment bond under NEC4 or JCT?

An advance payment bond guarantees repayment of a mobilisation or advance payment made by the employer to the contractor if the contractor fails to repay it as work proceeds. NEC4 contracts can call for one under the contract data, and JCT publishes its own Advance Payment Bond model form — our wording is drafted to match whichever applies.

What's the difference between an on demand and a conditional advance payment bond?

An on demand bond is payable on the beneficiary's first written demand, with no need to prove default. A conditional bond — the more traditional approach in the UK market — is only payable once default in repayment has actually been established against the contractor.

Does the bond value reduce as the advance is repaid?

It can. Many advance payment bonds are written on a reducing, or amortising, balance so the guaranteed amount steps down automatically as the advance is repaid through interim valuations — we can structure the wording either way depending on what your contract requires.
